A labor certification is a legal arrangement that allows a foreign worker to be permanently employed by a U.S. employer, in accordance with the U.S. Department of Labor. When this occurs, it is likely that the employer will be required to obtain a certified labor certification application at the Employment and Training Administration at the Department of Labor before the immigration petition for labor certification can be submitted. From this point, the Department of Labor will work on behalf of the employer to prove to the United States Citizenship and Immigration Services that there are no adequate workers who are able, qualified, available, and willing to perform said occupation. The DOL must also prove that the wages of the foreign national will not change due to his or her immigration status and will be at comparable levels with other U.S. employees.
